These Terms and Conditions govern the relationship between Site Sorted ("we", "us", "our") and any person or business ("you", "the Client") who engages us to build, host, or maintain a website. By proceeding with an order, you confirm that you have read and agree to these terms.

Site Sorted is a sole proprietorship operated in Cape Town, South Africa. All services are subject to South African law.

1. Services

We offer the following services:

  • Website build (once-off): a 4-page website including domain setup, business email, WhatsApp button, lead capture form, local SEO setup, Google My Business profile, and Google Analytics.
  • Hosting, maintenance & support (monthly): hosting and SSL, security updates, monthly performance checks, minor content updates, and priority WhatsApp support.

The scope of each engagement is agreed via WhatsApp before work begins. Any features not explicitly included in the agreed scope are out of scope and may be quoted separately.

2. Payment

2.1 Once-off website build

The current once-off fee is R4,995. Payment is due before work begins. We will not commence design, development, or domain registration until full payment has been received.

2.2 Monthly hosting & maintenance

The current monthly fee is R499 per month. The first three months are included free of charge with every website build. Thereafter, monthly billing begins automatically. Invoices are issued on the 1st of each month and are due within 7 days.

2.3 Accepted payment methods

We accept Visa, Mastercard, and Instant EFT. All prices are in South African Rand (ZAR) and are inclusive of VAT where applicable.

2.4 Late payment

If a monthly invoice remains unpaid after 14 days, we reserve the right to suspend your website and block your email until payment is received. We will make reasonable effort to contact you before suspending.

3. Delivery & Timelines

We aim to deliver completed websites within 7 business days of receiving full payment and the information needed to build your site (trade type, service areas, contact details, and any existing branding).

Timelines may be extended if:

  • You do not provide the required information promptly.
  • You request significant changes to agreed scope during the build.
  • Circumstances outside our control cause delays (e.g. domain registrar issues, third-party platform outages).

We will communicate any delays proactively via WhatsApp.

4. Your Responsibilities

You agree to:

  • Provide accurate information about your business, trade, service areas, and contact details.
  • Respond to our messages within a reasonable time to avoid delays.
  • Ensure you have the right to use any logos, images, or materials you provide to us.
  • Not use your website for any unlawful, fraudulent, or harmful purpose.
  • Keep your contact details (WhatsApp number and email) up to date with us.

We write your website content on your behalf based on information you provide. You are responsible for reviewing the content before launch and confirming its accuracy.

5. Ownership & Intellectual Property

5.1 Your website

Once the website has been paid for in full, the website content and design created specifically for you belong to you. You own your domain name, your written content, and your business identity.

5.2 Hosting

We manage your website hosting on your behalf. Your website is hosted on our infrastructure as part of the monthly plan. If you cancel the monthly plan and wish to move your website elsewhere, we will provide you with the website files within 14 days of your request. We do not charge a transfer fee.

5.3 Our tools and templates

We retain ownership of any underlying tools, frameworks, code libraries, and templates we use to build websites. These are not transferred to you.

5.4 Portfolio use

We may use your website as a portfolio example (e.g. on our own website or social media) unless you ask us not to. We will never share confidential business information.

6. Cancellation

6.1 Cancelling the monthly plan

You can cancel the monthly hosting and maintenance plan at any time by sending us a WhatsApp or email. Cancellation takes effect at the end of the current billing month. No partial refunds are issued for unused days within a billing month.

6.2 What happens to your website after cancellation

If you cancel the monthly plan and do not transfer your website to another host within 30 days, we reserve the right to take your website offline. We will remind you before doing so. We are not liable for any loss of business resulting from a website going offline after cancellation.

6.3 Cancelling a website build

If you cancel after work has begun but before launch, no refund will be issued. If you cancel before any work has begun, we will refund you in full minus any transaction fees that have been applied.

7. Changes & Updates

The monthly plan includes minor content updates (e.g. changing a phone number, updating service areas, adding a paragraph or sentence). It does not include:

  • Adding new pages or major new sections.
  • Redesigning the look and layout of the site.
  • Integrating third-party tools or booking systems.

Work outside the scope of minor updates will be quoted separately on request.

8. Limitation of Liability

We take our work seriously, but we cannot guarantee specific business outcomes (such as a certain number of leads or a particular Google ranking). SEO results depend on many factors outside our control.

To the fullest extent permitted by South African law, Site Sorted is not liable for:

  • Loss of revenue, loss of clients, or loss of business resulting from website downtime, errors, or delays.
  • Any inaccuracies in content that you approved before launch.
  • Third-party service failures (including domain registrars, Google, or hosting infrastructure providers).
  • Any damage caused by your use of your website in contravention of these terms.

Our total liability to you in any circumstance is limited to the amount you have paid us in the 3 months preceding the claim.

9. Privacy & Data

We collect only the information we need to deliver your website: your name, business name, trade, service areas, contact details, and payment information.

We do not sell or share your personal information with third parties, except where required to deliver the service (e.g. domain registrar) or where required by law.

We store communications on WhatsApp and email. By engaging us, you consent to us retaining these communications for business record-keeping purposes.

10. Disputes

If you are unhappy with our service, please contact us first at hello@sitesorted.co.za. We will make every reasonable effort to resolve disputes informally.

These Terms are governed by the laws of the Republic of South Africa. Any disputes that cannot be resolved informally will be subject to the jurisdiction of the South African courts.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify active clients via WhatsApp or email with at least 14 days' notice before the changes take effect. Continued use of our services after the notice period constitutes acceptance of the updated terms.
